Acceptance of Terms
By accessing shabgym.com, purchasing a membership, scheduling a session, or otherwise using THRYV’s Services, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, do not use the Services.
Eligibility
You must be at least 16 years old (or the age of majority in your jurisdiction) and capable of entering a binding contract. If you are under 18, you affirm that you have parental consent.
Health & Medical Disclaimer
THRYV’s coaches are fitness professionals, not medical practitioners. Always consult a physician before starting any exercise program. Participation is at your own risk. You acknowledge that physical exercise carries inherent risks, and you assume full responsibility for any injuries.
Memberships & Bookings
• Membership plans, session packs, and pricing are described on shabgym.com and may change from time to time.
• Sessions must be booked in advance via our online portal or in person and are subject to availability.
• Cancellation and rescheduling policies (including any applicable fees) are stated at checkout and in your account dashboard.
Payments, Refunds & Chargebacks
• All fees are payable in Canadian dollars plus applicable taxes.
• Recurring memberships renew automatically until cancelled.
• Refund requests are evaluated case‑by‑case in accordance with our posted refund policy.
• You agree not to initiate chargebacks before contacting us to resolve an issue.
User Responsibilities
You agree to:
• Provide accurate, current information.
• Not share your login credentials.
• Follow staff instructions and posted gym rules.
• Refrain from harassing or endangering others.
• Use the website and Services only for lawful purposes.
Intellectual Property
The Site, logos, programs, videos, and other content are the exclusive property of THRYV or its licensors and are protected by copyright and trademark laws. You may not reproduce or distribute them without prior written consent.
Privacy
Our use of your personal information is governed by our Privacy Policy (above), which is incorporated into these Terms.
Limitation of Liability
To the maximum extent permitted by law, THRYV, its directors, employees, and agents shall not be liable for indirect, incidental, consequential, or punitive damages, or any loss of profits, arising from your use of the Services.
Indemnification
You agree to indemnify and hold THRYV harmless from any claims, damages, or expenses (including legal fees) arising from your breach of these Terms or misuse of the Services.
Termination
We may suspend or terminate your account and access to the Services at any time for violation of these Terms or any applicable law. You may cancel your membership according to the process in Section 4.
Governing Law & Dispute Resolution
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. You agree to submit to the exclusive jurisdiction of the courts located in Toronto, Ontario. Before commencing litigation, the parties will attempt to resolve disputes in good‑faith informal negotiations.
Changes to Terms
We may revise these Terms periodically. Continued use of the Services after changes take effect constitutes acceptance.
